General Terms and Conditions.

ARTICLE 1 - APPLICATION OF THE GENERAL TERMS AND CONDITIONS OF SALE

These general terms and conditions of sale apply to all orders placed on the website www.clearmyvault.com by a professional or consumer customer for delivery of products in France, including the Overseas Departments and Regions (DROM) - Overseas Collectivities (COM) and outside French territory.

The consumer customer is understood as a "natural person who acts for purposes that do not fall within the scope of his commercial, industrial, craft, liberal or agricultural activity" (introductory article of the Consumer Code). The customer who does not fall within this definition cannot claim for his benefit the application of the contractual provisions applicable to the consumer customer alone.

The website www.clearmyvault.com is published by the company CLEARMYVAULT. The Seller is defined below as CLEARMYVAULT, registered with the Chamber of Commerce and Crafts (CMA). The Customer is understood as the one with whom the purchase-sale relationship is established and who is invoiced for the order. Any order placed on the website www.clearmyvault.com assumes that the Customer has read these General Terms and Conditions of Sale before concluding the sale and that they agree to their entire content. CLEARMYVAULT reserves the right to adapt or modify these General Terms and Conditions of Sale at any time. In this case, only the General Terms and Conditions of Sale in force when the order is placed will then be applicable.

ARTICLE 2 - ORDERS

2.1 Orders can be made on the website www.clearmyvault.com or by any other means remotely, including via a social network or by email to contact@clearmyvault.com after consulting the product range on the website www.clearmyvault.com.

2.2 French and english are the sole languages offered for the conclusion of the sales contract.

2.3 The availability of products is not displayed on the website www.clearmyvault.com, as products are mainly made to order.

2.4 Any quote offered to the customer by CLEARMYVAULT will remain valid for one month from the date of issue.

2.5 The characteristics of the products are indicated on each product page. The photographs and descriptive elements of the products do not enter into the contractual scope. Certain products marketed by CLEARMYVAULT require technical skills that the customer declares to have acquired or undertakes to acquire. Failing this, he cannot blame CLEARMYVAULT for a lack of knowledge.

2.6 In the event of unavailability of a product, CLEARMYVAULT will contact the Customer as soon as possible. The latter will then be informed of the deadlines for making the product available. If the Customer does not wish to wait for this availability or if the product is definitively unavailable and in the case where the order has been paid, CLEARMYVAULT undertakes to reimburse the Customer within 30 days following the date of payment by the Customer.

2.7 An order placed on www.clearmyvault.com does not require the creation of a Customer Account.

2.8 In order to place an order on www.clearmyvault.com, the Customer follows the various ordering steps. These correspond to the selection of the product(s) via the specific page for each product, to the correction or not of the number of products, to the acceptance of the order summary, to the acceptance of the General Conditions of Sale, to the acceptance of the payment terms, to the finalization of the order.

2.9 The checkbox on the acknowledgement and acceptance of the General Conditions of Sale validates the order and implies an obligation to pay for the customer. This action is equivalent to an "electronic signature" and a handwritten signature. They constitute an irrevocable and unreserved acceptance of the order as well as the General Conditions of Sale by the Customer. The data recorded by the Site www.clearmyvault.com on the Internet constitutes proof of all transactions between CLEARMYVAULT and its Customers and will be kept for a period of 5 years to allow the application of warranty services in particular. Any order placed by email from the products available on the site implies knowledge and acceptance by the customer of the General Conditions of Sale contained therein.

2.10 The invoice is communicated to the customer. The Customer is strongly advised to keep this invoice.

2.11 The order placed on www.clearmyvault.com may be automatically cancelled if payment is not received. This cancellation period is extended to 5 working days in the event of payment by bank transfer or via a dedicated payment platform.

2.12 In the event of an order placed by email to the address contact@clearmyvault.com after consulting the site www.clearmyvault.com, the Customer sends CLEARMYVAULT the references of the desired product(s) which appear on the Site.

2.13 CLEARMYVAULT reserves the right not to validate your order for any legitimate reason, in particular in the event of an abnormal request, a stock shortage, in general, in the event that the order does not comply with these General Terms and Conditions of Sale or in the event that several serious and concordant elements would raise suspicion of fraud on your order.

2.14 Only for consumer customers, outside the application of Article 6, the customer may cancel their order as long as it has not been shipped. However, certain items (parts made to order and not kept in stock) may not be refunded.

Concerning professionals, no unilateral cancellation of an order on their part will be accepted without the prior written consent of CLEARMYVAULT.

2.15 The information provided by the Customer when placing the order (in particular name and delivery address) is binding on the latter. Thus, CLEARMYVAULT cannot be held liable in any way in the event that an error when placing the order causes a delay or prevention of delivery.

ARTICLE 3 - PRICES

3.1 All prices of products and services offered for sale on the website www.clearmyvault.com are expressed in euros, VAT is not applicable, in accordance with article 293 B of the General Tax Code. Product prices are exclusive of shipping and order preparation costs.

3.2 Prices may be changed at any time and without notice. Products will be invoiced based on the rates in effect at the time orders are registered.

3.3 Products remain the property of CLEARMYVAULT until full payment of the price. Transfer of ownership of the products to the customer occurs upon full payment of the price. However, during the period from delivery to transfer of ownership, the risks of loss, theft or destruction are the responsibility of the customer.

3.4 Delivery costs, including shipping and packaging costs, will be specified on the order form before validation of the latter.

ARTICLE 4 - DELIVERY AND TRANSPORT

4.1 Deliveries are made to the delivery address indicated by the Customer when ordering, or to the relay point (if service offered) selected by the customer at the time of ordering. The customer is delivered to his home by the delivery person of the carrier selected by CLEARMYVAULT. In the event of the customer's absence, the delivery person leaves a calling card in the customer's mailbox, which will allow the package to be collected at the address and according to the terms indicated by the carrier.

4.2 The applicable delivery times are those indicated when confirming your order. Delivery times are in working days (excluding Saturdays, Sundays and public holidays).

4.3 Delivery times run from the date of validation of the order by CLEARMYVAULT. Delivery times are provided for information purposes only and correspond to processing and delivery times for products destined for Metropolitan France. For deliveries outside Metropolitan France, any customs fees are not managed by CLEARMYVAULT and will be the responsibility of the customer.

4.4 In the event of the delivery date being exceeded by more than 30 days and not due to a case of force majeure, the customer may cancel his order by registered letter with acknowledgement of receipt or by email to contact@clearmyvault.com. CLEARMYVAULT then undertakes to reimburse the customer within 15 days following the date on which the contract was terminated.

4.5 In the event that the order is made available at a relay point (if service offered) or in the event of failure to claim the package from the carrier within the time limit, the package will be returned to CLEARMYVAULT. The return and reshipping costs will then be borne by the customer.

4.6 CLEARMYVAULT cannot be held responsible for the consequences due to a delay in delivery that is not its fault or justified by a case of force majeure.

4.7 CLEARMYVAULT reserves the right to choose the carrier responsible for delivery. If the customer wishes to use a carrier other than the one proposed by CLEARMYVAULT, he must inform CLEARMYVAULT when ordering. In this case, CLEARMYVAULT cannot be held responsible for any failure by the carrier to meet its obligations.

ARTICLE 5 - CONFORMITY

5.1 The Customer is required to check the conformity of the delivered goods before signing any delivery document. In the event of an anomaly being found, the Customer must indicate his reservations, followed by his signature, directly on the delivery document. In the event of a serious anomaly being found (damaged or opened packaging, missing or damaged products, etc.), the Customer must refuse the package and specify on the delivery document the reasons for refusing to accept the package. This verification is considered to have been carried out from the moment the Customer, or any person authorized to receive the package on his behalf, has signed the delivery document.

5.2 In the event of failure to formulate reservations upon delivery, and if the customer finds that the equipment is damaged, the Customer must issue his reservations to CLEARMYVAULT, by registered letter with acknowledgment of receipt, within 3 working days following receipt of his order. Any claim made outside this period will not be accepted, in accordance with the general conditions of carriers and Article L.133-3 of the French Commercial Code, which is a matter of public policy.

5.3 CLEARMYVAULT undertakes to refund or exchange products that do not comply with the Customer's order. The Customer must then send their request in writing via the contact form on the website www.makershop.fr or by registered letter with acknowledgment of receipt to CLEARMYVAULT within 15 days following the delivery date. This claim relating to the non-conformity of a product with respect to their order must be accompanied by the Customer's choice between refund or exchange. Any claim made outside this period will not be accepted. Any exchange request by the Customer must comply with the procedure defined in Article 6.

5.4 In the cases referred to in this Article 5, the return of products will only be accepted for products returned complete, in their original condition (original packaging, instructions if applicable, accessories, etc.). In these same cases, the return costs will be reimbursed by CLEARMYVAULT.

ARTICLE 6a - RIGHT OF WITHDRAWAL

6a.1 The Customer has a legal period of 14 days of right of withdrawal from receipt of his order to return any item that does not suit him. In order to set up this return, the Customer must contact CLEARMYVAULT customer service via the contact form or directly by telephone. As provided by law, the right of withdrawal only applies to items returned unopened.

6a.2 In order to optimize the conditions for returning the product(s), it is imperative that the return be approved in advance by our Customer Service, which will send a return agreement to the Customer. Approval may be refused in the event of non-compliance with the withdrawal terms. The return may only be accepted if the product is in perfect condition, i.e. in its original packaging and undamaged. Items returned by the Customer that are damaged or in poor condition will be refused under the right of withdrawal. The return may then be made under the "14-day money-back guarantee" service. The customer is responsible for the return costs. CLEARMYVAULT undertakes to reimburse the transport costs of the product if these have been paid by the customer. Under common law, goods travel at the Customer's risk. CLEARMYVAULT recommends that the Customer take out all necessary insurance to cover these risks as well as all precautions for the protection of the product. The Customer's reimbursement will be made by crediting the Customer's bank account (or via a dedicated payment platform) used for the purchase within a maximum of 14 days following the date of receipt of the product by CLEARMYVAULT.

ARTICLE 6b - '14 DAYS MONEY BACK GUARANTEE' SERVICE

6b.1 The '14 days money back guarantee' service is a complementary and free service intended for consumer customers at the expense of CLEARMYVAULT for product return requests not falling within the scope of the right of withdrawal. In order to set up this return, the Customer must contact CLEARMYVAULT customer service via the contact form or directly by telephone.

6b.2 In order to optimize the conditions for returning the product(s), it is imperative that the return be approved in advance by our After-Sales Service, which will send a return agreement to the Customer. Approval may be refused in the event of non-compliance with the terms of the "14-day money-back guarantee" service. The return may only be accepted if the product is in perfect condition, i.e. in its original packaging, undamaged and accompanied by all its accessories. Items returned by the Customer that are incomplete, damaged or in poor condition will be refused. If the product meets the above conditions, CLEARMYVAULT may apply an unlimited discount depending on the condition of the equipment and accessories sold with it, and the packaging following use by the customer. The customer is responsible for the return costs. Shipping costs are not eligible for reimbursement. Under common law, goods travel at the Customer's risk if the latter has decided to take charge of the delivery. CLEARMYVAULT recommends that the Customer take all necessary insurance to cover these risks as well as all precautions for the protection of the product. The Customer's refund will be made by crediting the bank account used (or via a dedicated payment platform) for the purchase within a maximum of 30 days following the date on which the right of withdrawal was exercised.

ARTICLE 7 - PAYMENT

7.1 Orders are payable in cash on the day of the order for payments by bank card (CB, Mastercard, VISA) and via Paypal and Amazon Pay services (if offered). The entry of banking information is done on a secure server to guarantee the security and confidentiality of the information provided during the banking transaction.

7.2 Payment by bank transfer is available and must be made and received by CLEARMYVAULT no later than 5 days after the validation of the order by the Customer. In the event of non-payment after this period, CLEARMYVAULT reserves the right to cancel the order.

7.3 The order will only be considered accepted by CLEARMYVAULT when the relevant bank payment centers have given their agreement and CLEARMYVAULT has validated the order with regard to its risk acceptance criteria. In the event of refusal by said centers, the order will be automatically canceled and the Customer sent back to the Site to place a new order, if necessary.

7.4 In order to limit fraud, CLEARMYVAULT reserves the right to ask the Customer to provide proof of identity and address when accepting the sale. In this case, the order will be processed upon receipt of these documents. CLEARMYVAULT reserves the right to cancel the order if these supporting documents are not received or if supporting documents are not considered compliant.

7.5 Payment by Paypal and Amazon Pay (if offered) are subject to the conditions of said means of payment.

7.6 Payment means the collection of the amounts due and not the delivery of the means of payment. No retention of security is authorized. No discount is granted for early payment.

7.7 With regard to professional customers, in the event of non-payment on the agreed date, the customer will be liable for late payment penalties calculated on the basis of a rate equal to three times the legal interest rate. In addition, the customer will be liable for compensation for the processing of the payment incident equal to €40 excluding VAT. CLEARMYVAULT may suspend and/or cancel current orders and demand payment of all amounts including those not yet due. Any deduction is considered to be a payment incident. Similarly, no compensation may be made between reciprocal debts unless the debt held by the Customer on CLEARMYVAULT has been previously accepted in writing by the latter. Under no circumstances may a dispute allow the Customer to suspend payment. The customer must reimburse all costs incurred by CLEARMYVAULT for the recovery of unpaid products and the contentious recovery of amounts due, including the fees of lawyers and ministerial officers. In addition to these costs, the customer will be liable for a flat rate of €150 for contentious management of the non-payment.

ARTICLE 8 - WARRANTY

8.1 Legal guarantees

8.1.1 The products sold on the Site www.clearmyvault.com all benefit from the application of the legal guarantee of hidden defects resulting from articles 1641 et seq. of the Civil Code. The products sold to the professional customer also benefit from the guarantee of conformity provided for by the Civil Code, and the products sold to the consumer customer benefit in addition, from the legal guarantee of conformity provided for in article L. 217-4 et seq. of the Consumer Code.

The Customer may exercise these guarantees by sending his request by registered letter with acknowledgment of receipt to the head office, or via the support form or via the following email address: contact@clearmyvault.com.

Defects resulting from a fault in the use of the product are excluded from the legal guarantee.

8.1.2 For the consumer customer

When the consumer Customer acts under the legal guarantee of conformity, he:

- Will benefit from a period of two years from the delivery of the goods to act

- Will be exempt from providing proof of the existence of the lack of conformity of the goods during the twenty-four months following the delivery of the goods

The Customer may also decide to implement the guarantee against hidden defects of the thing sold within the meaning of article 1641 of the Civil Code and, in this case, he can choose between the termination of the sale or a reduction of the sale price in accordance with article 1644 of the Civil Code.

Any repair of the goods within the framework of the legal guarantee of conformity will benefit from an extension of said guarantee of six months for the consumer customer. In accordance with Article D.211-2 of the French Consumer Code, the terms of implementation of the legal guarantees applicable to the consumer customer are reproduced below:

"The consumer has a period of two years from the delivery of the goods to obtain the implementation of the legal guarantee of conformity in the event of the appearance of a lack of conformity. During this period, the consumer is only required to establish the existence of the lack of conformity and not the date on which it appeared."

"When the contract for the sale of the goods provides for the continuous supply of digital content or a digital service for a period exceeding two years, the legal guarantee is applicable to this digital content or this digital service throughout the planned supply period. During this period, the consumer is only required to establish the existence of the lack of conformity affecting the digital content or the digital service and not the date on which it appeared. »

« The legal guarantee of conformity requires the professional, where applicable, to provide all updates necessary to maintain the conformity of the good. »

« The legal guarantee of conformity gives the consumer the right to repair or replacement of the good within thirty days of his request, free of charge and without major inconvenience for him. »

« If the consumer requests the repair of the good, but the seller imposes the replacement, the legal guarantee of conformity is renewed for a period of two years from the date of replacement of the good. »

"The consumer may obtain a reduction in the purchase price by keeping the goods or terminate the contract by obtaining a full refund against return of the goods, if:

1 - The professional refuses to repair or replace the goods

2 - The repair or replacement of the goods occurs after a period of thirty days

3 - The non-conformity of the goods persists despite the seller's unsuccessful attempt to bring them into conformity."

"The consumer is also entitled to a reduction in the price of the goods or to the termination of the contract when the lack of conformity is so serious that it justifies that the reduction in the price or the termination of the contract be immediate. The consumer is then not required to request the repair or replacement of the goods in advance."

"The consumer is not entitled to the termination of the sale if the lack of conformity is minor."

"Any period of immobilization of the goods with a view to their repair or replacement suspends the warranty that remained to run until the delivery of the goods in good condition. »

« The rights mentioned above result from the application of Articles L. 217-1 to L. 217-32 of the Consumer Code. »

« The seller who hinders in bad faith the implementation of the legal guarantee of conformity is liable to a civil fine of a maximum amount of 300,000 euros, which may be increased to 10% of the average annual turnover (Article L. 241-5 of the Consumer Code). »

« The consumer also benefits from the legal guarantee of hidden defects in application of Articles 1641 to 1649 of the Civil Code, for a period of two years from the discovery of the defect. This guarantee gives the right to a price reduction if the good is kept or to a full refund against return of the good. »

8.1.3 For Professional Customers

The Customer benefits from a guarantee of conformity specified as follows and a guarantee of hidden defects under the conditions set by the Law. Concerning the guarantee of conformity, this is reduced under the conditions of article 5 above, including for wear parts defined without limitation in article 8.8. Thus, the guarantee of conformity expires within 3 days from the delivery date unless the product delivered does not comply with the order in reference and quantity. In this case, this guarantee of conformity expires within 8 days from the delivery date. After this period, the product delivered is deemed irrefutably compliant with the order.

8.1.4 In accordance with the law, reconditioned products are subject to a 6-month warranty extension for the consumer customer.

8.2 As soon as a problem occurs on the product(s) purchased on the Site www.clearmyvault.com, the Customer is required to contact CLEARMYVAULT either by registered letter with acknowledgment of receipt to ???, or via the Site's support form.

8.3 Product defect and support

8.3a For all customers (professionals and consumers) located in Metropolitan France, CLEARMYVAULT carries out a remote diagnosis in order to determine whether the product has a defect falling within the scope of the guarantees referred to above. When the defect falls within the scope of the guarantee, CLEARMYVAULT recovers the product at its own expense and carries out the necessary repairs or replacements.

8.3b For professional customers located in all DROM COM and other countries not mentioned in paragraph 8.3a, CLEARMYVAULT carries out a remote diagnosis in order to determine whether the product has a defect falling within the scope of the guarantees referred to above. When the defect has been identified as being within the scope of the warranty, the costs of sending the product to CLEARMYVAULT are the responsibility of the CUSTOMER.

8.4 If the problem with the product returned by the customer turns out to be outside the scope of the legal or commercial guarantees, the reshipping costs, as well as the initial shipping costs, will be the responsibility of the customer.

8.5 With the prior agreement of the customer, and in order to reduce delays and costs, a part(s) to be replaced may be sent to the customer instead of returning the equipment. The defective parts must be sent to CLEARMYVAULT before the replacement parts are returned.

8.6 Some parts of the equipment contracted by the customer are wear parts and cannot be taken into account within the framework of the legal and commercial guarantees [non-exhaustive list: GunReady inserts, RifleReady clip protection pads].

8.7 For reasons of safety and protection of the equipment during transport, any product returned from the CUSTOMER to CLEARMYVAULT must be made in the original packaging of the equipment. CLEARMYVAULT reserves the right to refuse upon receipt a product that reaches it in packaging other than the original packaging of the equipment.

8.8 In accordance with the law, spare parts for new goods will be available for the duration of the marketing of the products and for a minimum of 5 years from the date of placing on the market of the last unit of this product.

It is up to the Customer to ensure the compatibility of the equipment they order to the extent that they have been previously informed on the Site.

10.4 The warranty only covers material, consequential, direct and foreseeable damage related to the proven defect of the product, suffered exclusively by the Customer, demonstrated by him, excluding immaterial, non-consequential damage, operating losses, loss of customers, damage to image. In all cases, the customer must provide proof of his damage and its reality. No warranty is due due to any improper use or conservation or maintenance of the product by the Customer or by the latter's customers. Failure to comply with the rules provided in the technical documentation relating to a product excludes the application of the warranty for the product.

Some Questions ? Some answers.

How strong is it ?

Réponse à venir :)

Quelle est la Durée de garantie ?

Elle est de 2 ans, mais n'imaginez pas en avoir besoin.

Can RifleReady oR GunReady systems damage my guns ?

The French made security cabinets arrangement.
